1. Agreement to Terms

By accessing or using FlowTones at flowtones.app(“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and FlowTones. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

FlowTones is an AI-engineered music platform providing science-backed audio content designed to support cognitive states including focus, ADHD management, deep work, relaxation, and sleep. The Service is provided via a web application accessible at flowtones.app.

3. Account Registration

To access certain features of the Service, you must create an account. By creating an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorised use of your account.
• Accept responsibility for all activities that occur under your account.

You must be at least 13 years of age (or 16 in certain EU jurisdictions) to create an account and use the Service.

5. Subscriptions and Billing

FlowTones Premium is offered as a recurring subscription. By subscribing, you authorise us to charge your payment method on a recurring basis:

• Monthly plan: $8.99 per month, billed every 30 days.
• Annual plan: $59.99 per year, billed annually (saving ~44%).

All payments are processed securely by Stripe. We do not store your card details. Prices are displayed in USD and may vary by region due to currency conversion.

6. Cancellation and Refunds

You may cancel your subscription at any time from your Account settings page. Upon cancellation:

• Your access to Premium features will continue until the end of the current billing period.
• You will not be charged for subsequent billing periods.
• No partial refunds are provided for unused portions of a billing period.

Refund policy: We offer a 7-day money-back guarantee on your first subscription payment. If you are not satisfied, contact us at support@flowtones.app within 7 days of your first payment for a full refund. Subsequent charges are non-refundable.

7. Acceptable Use

You agree not to:

• Copy, download, redistribute, or resell the audio content provided by the Service.
• Use automated tools, bots, or scrapers to access the Service.
• Attempt to circumvent session limits, payment gates, or other access controls.
• Share account credentials with other users.
• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to reverse engineer, decompile, or extract source code from the Service.

8. Intellectual Property

All content on FlowTones, including audio tracks, AI-generated music, website design, logos, and software, is owned by or licensed to FlowTones and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes only.

The audio content is generated using AI tools (Suno, ElevenLabs) under their respective commercial licences. You may not reproduce, distribute, or create derivative works from our audio content.

9. Disclaimer of Warranties

FlowTones is provided on an “as is” and “as available” basis without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or suitable for any particular purpose.

Medical disclaimer: FlowTones is not a medical device or therapeutic service. Our audio content is not intended to diagnose, treat, cure, or prevent any medical or psychological condition, including ADHD. If you have a health concern, please consult a qualified healthcare professional.

10. Limitation of Liability

To the fullest extent permitted by applicable law, FlowTones shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
